With So Much at Stake at a Social Security Disability Hearing

You Need A Premier Disability Attorney Fighting On Your Behalf

The Social Security Disability Insurance program, with its monthly benefit payments and medical coverage, can serve as a financial lifeline when you cannot work for a year or longer due to a disabling medical condition. However, two-thirds of the people who apply for SSDI are denied benefits.

If your request for a reconsideration did not result in approval of the claim, do not give up. Instead, contact the Keener Law Firm to appeal the denial of benefits at a hearing with an administrative law judge.

Skilled representation from an experienced disability lawyer can make the difference between winning and losing at the hearing level, an essential stage in the appeal process. About 50% of the cases heard at the hearing level result in an outcome favorable to the claimants.

Although the law does not require that you have a disability attorney representing you at a hearing, it helps to have someone on your side who knows the laws, regulations, and procedures. The United States Government Accountability Office reports that claimants with representation are three times more likely to be successful than those without it, so contact Keener Law to learn more about the difference a disability hearing lawyer could make in your case.

Essential Things To Know About A Social Security Disability Hearing

You have 60 days from when you receive a denial notice after the initial application review to request reconsideration of your claim. Reconsideration assigns the application to a new team to review, along with any additional documentation that you submit in support of it.

If reconsideration results in a denial of benefits, you have 60 days to appeal the decision by requesting a hearing with an administrative law judge (ALJ). A hearing is a formal proceeding presided over by an ALJ.

It takes some time for the Social Security Administration to schedule a hearing date, but your disability attorney uses the time to review the Social Security file and decide on what medical and other evidence may be needed to support the claim. Your representative ensures that the submission of the evidence complies with federal rules and takes place in advance of the hearing.

The ALJ conducts the hearing and may question you and other witnesses, including medical and vocational experts, about your medical condition to determine whether you meet the requirements for disability benefits. Hearings tend to be informal, but all proceedings, including the testimony of witnesses, are preserved through audio recordings.

Your disability attorney has an opportunity to present and question witnesses. A hearing is your opportunity to provide information in support of your claim for Social Security Disability benefits through your response to questions from the ALJ and your disability lawyer. Topics you may be asked about include:

  • Whether you continue to work.
  • The type of work you did in the past.
  • Information about your education and vocational training background.
  • Details about your disability, including the date when symptoms started.
  • Details about work-related limitations you experience because of your medical condition.

A hearing can be intimidating for a claimant attending one for the first time. The team of disability professionals at Keener Law spends time before your hearing to explain the process and review your case file with you to ensure that you feel confident and prepared.

Hiring an experienced SSDI hearing attorney from the Keener Law Firm provides you with a skilled advocate capable of questioning witnesses, gathering and presenting evidence, and calling upon expert witnesses to strengthen your claim. Most importantly, a Keener Law disability attorney has the ability developed from years of training and experience to present your case, including legal arguments, to persuade the ALJ of the validity of your claim for SSDI benefits.
